Grupo Piñero's Ethics Channel ensures direct, confidential and secure communication of queries and complaints from Members of the Organisation, Business Partners and/or Third Parties, in accordance with internal and external regulatory compliance and with Law 2/2023, of 20 February, regulating the protection of persons who report breaches of regulations and the fight against corruption.
Whistleblowers who wish to use Grupo Piñero's Ethics Channel may submit queries and complaints, either anonymously or with prior identification.
Queries should include the following information:
- Date of submission of the query.
- If the query is not anonymous, name and contact details of the Informant. In order to facilitate a response to the query, it is advisable to include the Whistleblower Channel User's identity in the query. The identity of the Whistleblower Channel User will be actively protected and will therefore be kept confidential.
- A clear explanation, as detailed as possible, of the issue requiring clarification or response and the reason for seeking such clarification, response or judgement.
- If applicable, the Standard, Policy or Procedure about which the question arises.
- Any other information or document that the Informant deems appropriate to provide.
Complaints should include the following content as a minimum:
- Date of submission of the complaint.
- If the complaint is not anonymous, name and contact details of the Informant.
- A clear and detailed explanation of the facts.
- Identification of the perpetrator, other persons who may have been involved and persons who may have knowledge of the facts.
- Name and contact details of the Informant, as long as the complaint is not anonymous. In order to facilitate investigation of the reported facts, it is advisable to include the Complainant’s identity, which will be actively protected and will therefore be kept confidential.
- When the breach occurred or whether it is ongoing at the date the complaint is lodged.
- Any other information, document and/or evidence that the Informant deems appropriate to provide.
False or malicious allegations may give rise to the corresponding sanctions, without prejudice to the civil or even criminal liabilities that may be incurred in accordance with current legislation.
Although it is advisable to include the Complainant’s identity, which will be actively protected and will therefore be kept confidential, in order to facilitate investigation of the reported facts, the complaint may also be lodged anonymously.
